These Terms of Service ("Terms") govern your use of https://viqq.net and your relationship with VIQQ Studio ("VIQQ," "we," "us") when you inquire about or purchase web design, SEO, advertising, AI, or related digital services. By using this website or engaging us, you agree to these Terms.
About our services
VIQQ provides custom websites, landing pages, local SEO, paid media setup, branding, and AI automation for businesses — primarily in Miami and South Florida. Service scope, deliverables, timeline, and fees are defined in a written proposal, statement of work, or invoice — not solely by marketing copy on this site.
Website use
- Content on this site is for general information and marketing. It is not legal, financial, or guaranteed performance advice.
- You may browse the site for lawful purposes. Do not attempt to disrupt, scrape, or reverse-engineer the site or its systems.
- Do not submit false information through our forms or impersonate others.
- We may update, suspend, or remove site content at any time without notice.
Quotes, proposals, and agreements
Estimates on the website, in quizzes, or in informal email are directional unless confirmed in a signed or written agreement. A project begins only after both parties agree to scope, timeline, and payment terms. If there is a conflict between these Terms and a signed project agreement, the signed agreement controls for that project.
Client responsibilities
To deliver work on schedule, clients typically agree to:
- Provide accurate business information, brand assets, logins, and content in a timely manner
- Review drafts and approve milestones within agreed timeframes
- Ensure they have rights to materials they supply (photos, logos, copy, trademarks)
- Maintain their own domain, hosting, ad accounts, or third-party subscriptions when those are not included in scope
Delays caused by missing assets or approvals may shift timelines and are not our responsibility.
Payment
- Payment terms (deposit, milestones, retainers) are specified in your proposal or invoice.
- Work may pause if invoices are overdue.
- Fees are for services rendered unless otherwise stated. Third-party costs (ads spend, stock assets, premium plugins, domains) are usually billed separately or paid directly by the client.
Intellectual property
- Client deliverables — Upon full payment for a project, clients receive ownership or license to final agreed deliverables (for example, custom site design and code created for them), as stated in the project agreement.
- Pre-existing tools — We may reuse frameworks, components, or internal tools. We retain ownership of our methodologies, templates, and non-client-specific assets.
- Portfolio — Unless agreed otherwise in writing, we may display completed work in our portfolio, case studies, and marketing materials.
Third-party platforms
Projects often involve third-party services (hosting, Google, Meta, Shopify, WordPress, analytics, email providers). Their terms and policies apply to your use of those platforms. We are not responsible for outages, policy changes, or account suspensions caused by third parties.
SEO, ads, and performance
We build sites and campaigns to follow best practices, but we do not guarantee specific rankings, traffic, leads, revenue, or ad ROAS. Search engines and ad platforms change algorithms and policies without notice. Results depend on market, budget, competition, and ongoing effort.
Revisions and support
Included revision rounds and post-launch support windows are defined in your project agreement. Additional changes outside scope may be billed at our then-current hourly or project rates.
Confidentiality
We treat non-public business information shared for a project as confidential and use it only to perform services. Clients should not share passwords or sensitive data through unsecured channels when a secure method is available.
Limitation of liability
To the fullest extent permitted by law, VIQQ is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or business opportunities. Our total liability for any claim relating to services or this site is limited to the amount you paid VIQQ for the specific project giving rise to the claim during the twelve (12) months before the claim, or one hundred U.S. dollars ($100) if no fees were paid, whichever is greater.
Indemnification
You agree to indemnify and hold VIQQ harmless from claims arising out of materials you provide, your use of deliverables in violation of law, or your breach of these Terms — except to the extent caused by our gross negligence or willful misconduct.
Termination
Either party may terminate a project as set out in the project agreement. Upon termination, you pay for work completed to date and any non-refundable costs incurred. We may refuse or discontinue service if you breach these Terms or engage in abusive conduct.
Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Disputes shall be brought in courts located in Miami-Dade County, Florida, unless otherwise required by applicable law.
Changes
We may update these Terms from time to time. The "Last updated" date shows the current version. Continued use of the site after changes constitutes acceptance of the revised Terms.
